Elizabeth Cady Stanton and the Feminist Foundations of Family Law Book Excerpt:

Much has been written about women’s rights pioneer Elizabeth Cady Stanton. Historians have written her biography, detailed her campaign for woman’s suffrage, documented her partnership with Susan B. Anthony, and compiled all of her extensive writings and papers. Stanton herself was a prolific author; her autobiography, History of Woman Suffrage, and Woman’s Bible are classics. Despite this body of work, scholars and feminists continue to find new and insightful ways to re-examine Stanton and her impact on women’s rights and history. Law scholar Tracy A. Thomas extends this discussion of Stanton’s impact on modern-day feminism by analyzing her intellectual contributions to—and personal experiences with—family law. Stanton’s work on family issues has been overshadowed by her work (especially with Susan B. Anthony) on woman’s suffrage. But throughout her fifty-year career, Stanton emphasized reform of the private sphere of the family as central to achieving women’s equality. By weaving together law, feminist theory, and history, Thomas explores Stanton’s little-examined philosophies on and proposals for women’s equality in marriage, divorce, and family, and reveals that the campaigns for equal gender roles in the family that came to the fore in the 1960s and ’70s had nineteenth-century roots. Using feminist legal theory as a lens to interpret Stanton’s political, legal, and personal work on the family, Thomas argues that Stanton’s positions on divorce, working mothers, domestic violence, childcare, and many other topics were strikingly progressive for her time, providing significant parallels from which to gauge the social and legal policy issues confronting women in marriage and the family today.

The 18th New York Infantry in the Civil War Book Excerpt:

Responding to President Lincoln’s initial call for troops, the 18th New York Infantry emerged as one of the Excelsior State’s first regiments and mustered many of its earliest volunteers. Formed of companies from across the state, the unit saw combat early, suffering the first casualties of the Bull Run campaign when they were ambushed on the march four days before the battle. As part of the Army of the Potomac, they fought at Gaines’s Mill, Crampton’s Gap, Antietam, Fredericksburg and Chancellorsville. Drawing on numerous sources including several unpublished letters and diaries, this book gives the complete history of the 18th—from the first enlistee to the last surviving veteran (who died in 1938)—with an emphasis on the experiences of individual soldiers.

The Antebellum Origins of the Modern Constitution Book Excerpt:

This book argues that conflicts over slavery and abolition in the early American Republic generated a mode of constitutional interpretation that remains powerful today: the belief that the historical spirit of founding holds authority over the current moment. Simon J. Gilhooley traces how debates around the existence of slavery in the District of Columbia gave rise to the articulation of this constitutional interpretation, which constrained the radical potential of the constitutional text. To reconstruct the origins of this interpretation, Gilhooley draws on rich sources that include historical newspapers, pamphlets, and congressional debates. Examining free black activism in the North, Abolitionism in the 1830s, and the evolution of pro-slavery thought, this book shows how in navigating the existence of slavery in the District and the fundamental constitutional issue of the enslaved's personhood, Antebellum opponents of abolition came to promote an enduring but constraining constitutional imaginary.

Revolutions and Reconstructions Book Excerpt:

Revolutions and Reconstructions gathers historians of the early republic, the Civil War era, and African American and political history to consider not whether black people participated in the politics of the nineteenth century but how, when, and with what lasting effects. Collectively, its authors insist that historians go beyond questioning how revolutionary the American Revolution was, or whether Reconstruction failed, and focus, instead, on how political change initiated by African Americans and their allies constituted the rule in nineteenth-century American politics, not occasional and cataclysmic exceptions. The essays in this groundbreaking collection cover the full range of political activity by black northerners after the Revolution, from cultural politics to widespread voting, within a political system shaped by the rising power of slaveholders. Conceptualizing a new black politics, contributors observe, requires reorienting American politics away from black/white and North/South polarities and toward a new focus on migration and local or state structures. Other essays focus on the middle decades of the nineteenth century and demonstrate that free black politics, not merely the politics of slavery, was a disruptive and consequential force in American political development. From the perspective of the contributors to this volume, formal black politics did not begin in 1865, or with agitation by abolitionists like Frederick Douglass in the 1840s, but rather in the Revolutionary era's antislavery and citizenship activism. As these essays show, revolution, emancipation, and Reconstruction are not separate eras in U.S. history, but rather linked and ongoing processes that began in the 1770s and continued through the nineteenth century.
