Description : The 112th Congress may face a number of issues regarding the development of civilian capabilities to carry out stabilization and reconstruction activities. In September 2008, Congress passed the Reconstruction and Stabilization Civilian Management Act, 2008, as Title XVI of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (S. 3001, P.L. 110-417, signed into law October 14, 2008). This legislation codified the existence and functions of the State Department Office of the Coordinator for Reconstruction and Stabilization (S/CRS) and authorized new operational capabilities within the State Department, a Civilian Response Corps (CRC) of government employees with an active and a standby component, and a reserve component. S/CRS slowly expanded, and the creation of the active and standby response components is in progress. Nevertheless, some members have argued for changes. S/CRS was established in 2004 to address long-standing concerns, both within Congress and the broader foreign policy community, over the perceived lack of the appropriate capabilities and processes to deal with transitions from conflict to stability. These capabilities and procedures include adequate planning mechanisms for stabilization and reconstruction operations, efficient interagency coordination structures and procedures in carrying out such tasks, and appropriate civilian personnel for many of the non-military ...

Description : The key issue in this examination is whether OASD(PA) outreach activities involving retired military analysts (RMAs) were conducted for "publicity or propaganda purposes not authorized by Congress," thus, raising the possibility of violating prohibitions on using appropriated funds for such purposes. In our review, the evidence in this case was insufficient to conclude that those outreach activities, beginning in October 2002 and extending through April 2008, violated statutory prohibitions on publicity or propaganda. However, we acknowledge that Section 1056 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 requires the Comptroller General of the United States to render a definitive legal opinion to the Congress on the matter.

Description : As required by law, the May 2009 Department of Defense (DoD) Chemical Demilitarization Program (CDP) Semi-Annual Report to Congress presents information describing DoD's progress toward destruction of the U.S. stockpile of lethal chemical agents and munitions by the Chemical Weapons Convention (CWC) deadline of April 29, 2012, and not later than December 31, 2017. This report provides the results of the review by the DoD from assessments conducted to identify options to accelerate destruction of the remaining chemical weapons stockpile, and the current path forward resulting from that review. In addition, as required by section 922 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (PL 110-417), this report provides the results from a recent assessment on on-site and off-site treatment and disposal of secondary wastes, including hydrolysates, conducted by the Program Manager, Assembled Chemical Weapons Alternatives (PM ACWA).

Description : The wars in Iraq and Afghanistan have highlighted the continuing need to improve the Department's ability to rapidly respond to urgent warfighter requirements against a highly adaptive enemy. The Department has created or modified numerous urgent needs processes to assist in countering enemy threats by expediting the fielding of warfighter urgent operational needs. The Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 directed the Secretary of Defense to commission a study and report to Congress to assess the effectiveness of the processes used by the Department of Defense for the generation and fulfillment of urgent operational needs. A Defense Science Board Task Force was established in December 2008 to conduct the study. Its report to Congress in July 2009 included recommendations for the Department of Defense to formalize two paths?one for urgent and the other for normal acquisitions; establish a $3 billion per year fund for rapid acquisition and fielding; and establish a new Defense Agency, the Rapid Acquisition and Fielding Agency, to fulfill the urgent operational needs of the warfighter. Key members of the Department?s new leadership have received this report and have incorporated it into their deliberations on how to more effectively support the current war in Afghanistan and Iraq and future operations.
