Excerpt: ...District of New York, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel for the seizure and condemnation of 4 packages, containing approximately 200 pounds of a product purporting to be oil of birch, remaining unsold in the original unbroken packages at New York, N. Y., alleging that the product had been shipped from the State of Tennessee into the State of New York, the shipment having been received on or about November 5 and 6, 1914, and charging adulteration and misbranding in violation of the Food and Drugs Act. The product was ordered by consignee and forwarded by shipper as oil of birch. Adulteration was alleged in the libel for the reason that the product was offered for sale as oil of birch, when, in fact, it consisted largely of methyl salicylate which had been mixed, packed with, and substituted for oil of birch. Misbranding was alleged for the reason that said product was offered for sale by the shipper thereof as oil of birch, whereas, in truth and in fact, said product consisted largely of methyl salicylate which was substituted for the pure oil. On January 14, 1915, no claimant having appeared for the property, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product should be destroyed by the United States marshal. Have been a sufferer from the dreaded complaint since the winter of 1888. Every winter would be obliged to leave my bed seyeral times thiough the night to rel ieve myself by burning a fumigator, inhaling the smoke. About two months ago I received your lette1 directing me to get a bottle of your medicine from our druggist\ I did so, Found some relief from the trial bottle. Have used it since, and feel now as if entirely cured. Have kept my bed at night and slept sweetly; never once being obliged to rise until morning. I feel as though I had a new lease of life. Am st1ong and heaity as an 011. Fiiends me all surprised. Hoping all sufierers will be able to try your valuable and priceless 1emedy.' About seven months ago he told me that Chicago was a bad place for asthma, and I was the worst case he ever saw. If it were not that I had a constitution like a horse, I would have died. I got to Kansas City, Mo. I got a doctor again, a good doctor. He gave me a medicine but done me no good, so he doubled the dose and I got relief for the time being. Excerpt: ...An examination of samples of said product made by the Bureau of Chemistry of the United States Department of Agriculture showed the following results: (500 gram sample) Live worms, 31; live beetles, 3; dead fly, 1; an undue amount of skins, imperfect portions left in the apples that should have been trimmed out, and too much fine material to warrant grading as "Choice." Misbranding was alleged for the reason that the product was represented on the label to be choice ring evaporated apples, which statement was false and misleading and calculated to deceive and mislead the purchaser, for the reason that the product was not as represented, but was a low grade of evaporated apples composed of an undue amount of skins, imperfect por tions left in the apples that should have been trimmed out, and too much fine material to warrant being graded as choice. Adulteration was alleged for the reason that the product consisted in part of a filthy, decomposed, and putrid animal or vegetable substance, to wit, live worms, live beetles, dead flies, cores and skins of apples. On December 7, 1911, the defendants pleaded guilty, and each was On May 31, 1911, the United States Attorney for the Southern District of Ohio, acting upon a report by the Secretary of Agriculture, filed information in the District Court of the United States for the said district against the Mihalovitch Co., a corporation, alleging shipment by it, in violation of the Food and Drugs Act, on or about October 20, 1910, from the State of Ohio into the State of Pennsylvania of a quantity of peppermint extract which was adulterated and misbranded. Description : Excerpt from Notices of Judgment Under the Food and Drug Act: No. 451-501 On or about February 1, 1910, the Pendleton Grain Company, St. Louis, Mo., shipped from the State of Missouri to the State of Arkan sas, one carload of white oats. Analysis of sample of this product made in the Bureau of Chemistry, United States Department of Agriculture showed it to be adulterated within the meaning of the Food and Drugs Act of June 30, 1906. AS it appeared from the find ings of the analyst and report made that the shipment was liable to seizure under Section 10 of the act, the Secretary of Agriculture re ported the facts to the United States attorney for the Eastern District of Arkansas. In due course a libel was filed against the said carload of white oats, charging adulteration of the product within the mean ing of the act because it consisted of 9. 2 per cent. Barley, 6. 8 per cent. Wheat, per cent. Debris, weed seed, chaff, etc. And the balance White oats, and was misbranded m that the carload was invoiced, labeled and branded as No.3 White Oats, which statements were false, misleading and deceptive because they Were not white cats but a mixture of white oats, barley, weed seeds, debris, wheat, chaff, etc. Thereupon H. K. Cochran, Little Rock, Ark, made an appearance as claimant, and the case coming on for a hearing, the court rendered its decree of condemnation and forfeiture and ordered that the said product be delivered to claimant upon being branded White Oats, mixed with weed seed, wheat, barley, chaff, etc.' and upon a bond being filed conditioned that the product be not sold in violation of the law Of any state, territory or insular possession of the United.
