Description : This book analytically reviews the impact of the global anti-money laundering and counter-terrorist financing (AML/CFT) framework on the compliance trajectory of a number of jurisdictions to this framework. The work begins by examining the international financial sector reform and its evolution to inculcate the global framework for AML/CFT regulations. It challenges the resulting uniform AML/CFT due to its paradoxical impact on the compliance trajectory of African countries and emerging economies (ACs/EEs). This is done through an examination of the pre-conditions for effective regulation and compliance drivers for ACs/EEs that reveals the behavioural impact of the AML/CFT standards on the bloc of countries. Through the application of agency theory, it explores the relationship between ACs/EEs on the one hand and the international financial institutions that formulate, disseminate and facilitate compliance with the global framework for AML/CFT standards on the other. The remaining chapters review empirically the compliance pressures and resulting compliance trajectory of ACs/EEs with the AML/CFT standards. The final part of the book provides a detailed explanation of the compliance challenges of ACs/EEs and the legitimacy concerns that facilitate this. This book offers a new direction on the impact of global AML/CFT standards on ACs/EEs and contributes to the understanding of the conditions under which the global standards are likely to facilitate proactive compliance within these blocs of countries. As such it will be a valuable resource for academics, researchers and policy-makers working in this area.

Description : Better Regulation in the EU is a perennial and topical question which has important implications for the future direction of EU law. While actions directed at improving the quality and accessibility of EU regulation are not novel, in recent years the Better Regulation Agenda has significantly affected the structural organisation and day-to-day operation of the EU legislative process. Yet, many questions about the future of the Agenda remain, not least in light of Brexit. Exploring the Better Regulation Agenda (and its relation to the overall EU legal and political order) necessitates an integrated, interdisciplinary approach. This edited volume presents insights from economics, political science and legal scholarship. Furthermore, to allow full understanding, it examines institutional practice, where the Agenda is made and shaped on a daily basis. Hence, the book features contributions from the perspective of the work of the main EU institutions: the European Commission, the Parliament, the Council and the Court of Justice. This results in a seminal overview of the subject, of interest to scholars and practitioners alike.

Description : Zoonoses—infectious diseases, such as SARS and mad cow, that originate in animals and spread to humans—reveal how intimately animal and human health are linked. Complicating this relationship further, when livestock are given antibiotics to increase growth, it can lead to resistant bacteria. Unfortunately, there are few formal channels for practitioners of human medicine and veterinary medicine to communicate about threats to public health. To address this problem, Dr. Laura H. Kahn and her colleagues are promoting the One Health concept, which seeks to increase communication and collaboration between professionals in human, animal, and environmental health. In One Health and the Politics of Antimicrobial Resistance, Dr. Kahn investigates the use of antibiotics and the surge in antimicrobial resistance in food animals and humans from a One Health perspective. Although the medical community has blamed the problem on agricultural practices, the agricultural community insists that antibiotic resistance is the result of indiscriminate use of antibiotics in human medicine. Dr. Kahn argues that this blame game has fueled the politics of antibiotic resistance and hindered the development of effective policies to address the worsening crisis. Combining painstaking research with unprecedented access to international data, the book analyzes the surprising outcomes of differing policy approaches to antibiotic resistance around the globe. By integrating the perspectives of both medicine and agriculture and exploring the history and science behind the widespread use of growth-promoting antibiotics, One Health and the Politics of Antimicrobial Resistance examines the controversy in a unique way while offering policy recommendations that all sides can accept.

Description : The impact of mining is too big to ignore in a world of oversubscribed water. This is true of conventional mining as much as – or even more than – hydraulic fracturing (fracking). The legacy issues of such mining on water have not been fully appreciated, especially the irretrievable effects mining has had on communities and ecosystems around the world through its impact on water. Yet this is not an ‘us-or-them’ problem: the wealth, influence and technical knowledge of mining interests can and must be part of the solution. All of the contributions to this volume either consider the deficiencies of existing governance structures and the need for better ones, or explore the use of new techniques to identify and evaluate social and environmental impacts. The chapters in this book were originally published in the journal Water International.

Description : Often in their careers, social workers will encounter clients who are either legally required to attend treatment services or are otherwise coerced or pressured into those services. Practitioners in settings from prisons to emergency rooms to nursing homes to child protection agencies will find themselves with involuntary clients. In an update to this classic text, social workers Ronald H. Rooney and Rebecca G. Mirick explore the best ways to work with unwilling clients. While work with involuntary clients is common, it can be challenging, frustrating, and unproductive unless practitioners are well trained for it. This book provides a theoretical framework for understanding the legal, ethical, and practical concerns when working with involuntary clients, offering theory, treatment models, and specific practice strategies influenced by the best available knowledge. Animated by case studies across diverse settings, these resources can be used by practitioners to facilitate collaborative, effective working relationships with involuntary clients.

Description : Private Law in the External Relations of the EU is an innovative study of the interactions between EU external relations law and private law, two unrelated fields of law, inverted if private law is understood as regulatory private law - the space where regulatory law intersects with private economic activity. Here the link between the Internal Market and the global market - and thereby international law - is much more prominent. In this book, key questions about the relationship between EU external relations law and private law are answered, including: in what ways might European private law act as a tool to achieve EU external policy objectives, particularly in regulatory fields? How might the quickly developing EU external competence over the procedural dimensions of private law, including private international law, impact on substantive law, both externally and internally? And how is the legal position of private parties affected by EU external relations? In asking these questions, this edited collection opens up a field of enquiry into the so far underexplored relationship between these two fields of law. In doing so, it addresses three different aspects of the relationship: (i) the evolution of the EU competence, (ii) the ways in which EU private law extends its reach beyond the boundaries of the internal market, and (iii) the ways in which the EU contributes to the formation of private regulation at the international level.

Description : Although law and science have interacted for centuries, today their interactions pose enormous challenges. These challenges are reflected in issues ranging from reproductive technology and resource conservation, to genetic technology and biological warfare. The emerging dialogue is complex and requires an ongoing re-thinking of general principles, such as expert biological evidence, which features in a wide range of legal contexts, and including medical law, torts, crime and intellectual property. Studying the many ways in which law and biology come together in many areas of contemporary life, The Nexus of Law and Biology: New Ethical Challenges explores the juridical uses of biological sciences to illuminate key issues and contemporary intersections, arguing that each of several disciplines must communicate with one another, recognizing a common ground in ethics. Featuring an impressive list of contributors, this book is an invaluable reference for legal scholars, students, practising lawyers and scientists engaged with the legal system.
