Description : Weissenberger's Michigan Civil Procedure Litigation Manual provides a thorough, yet concise, analysis of the Michigan Court Rules. It is intended to aid the practitioner, judge, and student alike in understanding the operation and application of the Rules in situations that recur throughout the course of litigation. Although this manual is not exhaustive of every procedural issue in Michigan, it is anticipated that it will function both to identify other additional sources on Michigan law as well as to resolve problems frequently engendered by the application of the Rules. Each chapter contains the full text of each Rule in a format that lends itself to easier examination and dissection than any other currently available. Practical commentary on each rule is also provided, as are hundreds of illustrations of possible applications. This publication also includes a list of additional Michigan authorities and a carefully-selected list of leading cases. These cases are intended to serve as starting points for additional research; comprehensive annotations are beyond the scope of this manual. This manual also contains a host of other useful features, including a directory of all clerks of court within the state of Michigan, a note on judicial rulemaking in Michigan, an appellate district map, official forms, and a table used to calculate the number of days between two dates, as well as the full text of the Michigan Rules of Appellate Procedure.

Description : Designed specifically for trial use, Michigan Evidence Courtroom Manual's purpose is to provide fast, concise, and authoritative answers to most of the evidentiary questions which arise in the course of trials and hearings, as well as in trial preparation. It accomplishes this through a unique combination of trial-tested features, including: • Rules: The complete rules are collected at the beginning of the book. Individual rules are also at the beginning of the chapter in which the rule is discussed. • Commentary: Perhaps the most important part of this book, the author's Commentary provides a quick overview of the rule under discussion, guidance in interpreting the rule, and helpful pointers for applying the rule in actual practice. In many chapters the Commentary contains special features such as Illustrations, Constitutional Considerations, and Current Trends. • Authority: Following each chapter's Commentary, additional authorities are cited. These give the user a starting point for additional research. • Comparison to Federal Rule: A brief comparison of the Michigan and federal rules in each chapter provides additional insight. • Cases: Recent significant cases are summarized at the end of each chapter. These provide support for argument and decisions required during the course of proceedings.

Description : Many controversies in American criminal law reflect the tension between older and newer conceptions of the purposes of punishment. The English common law of crimes enforced a royal peace by conditioning punishment on unauthorized force and harm to particular victims. The story of American criminal law has been the emergence of a more utilitarian conception of criminal offending as the imposition of risk or the violation of consent, combined with culpability. This conception is reflected in the Model Penal Code and many state codes. Yet understanding contemporary criminal law requires that we also remember the model of offending as trespass against sovereignty out of which it emerged. The Oxford Introductions to U.S. Law: Criminal Law reviews the development of American criminal law and explains its key concepts and persistent controversies in light of its history. These key concepts include retribution and prevention as purposes of punishment; the requirements of a criminal act and a culpable mental state; criteria of causal responsibility; modes of violating consent; inchoate offenses, including attempt and conspiracy; doctrines of participation in crime; and defenses of justification and excuse.
