Description : Excerpt from Notice of Judgment No. 2113: Given Pursuant to Section 4 of the Food and Drugs Act Oh August 6, 1912, the United States Attorney for the Southern District of' New York, acting upon a report by the Secretary of Agri cult/ure, filed in the District Court of the United States for said district an information against Ungerer Cc., a corporation, New York, N Y., alleging the shipment by said company, in Violation of the' -food and Drugs Aet, on July 8, 1911, from the State of New York into the State of Michigan of a quantity of oil of sassafras which Was adulterated. The product was labeled: Oil sassafras true, Ungerer Co. N Y. (serial No. 521. 8 oz.) Analysis of a sample of the product by the Bureau of Chernistry of this Departrnent showed the following results: Specific gravity, at 25° C.° rotation 100 mm tube, 1 77° refractive index at 20. +1. 5313; fractional distillation, below 12 per cent; 230 44 per cent; 235 - 237° 36 per cent; residual oil, 8 per cent. This product is recognized in the United States Pharmacopoeia. Adulteration of the product was alleged ln the information for. The reason that it was sold under and by a name recognized in the United States Pharmacopoeia or National Formulary, to wit, oil of sassafras, and it differed from the standard of strength, quality, and purity as determined by the tests laid down in the said Pharmacopoeia official at the time of investigation, that is to say, it had been adulter ated with safrol and the standards of strength, quality, and purity were not stated upon the container of the product. Description : Excerpt from Notices of Judgment Under the Insecticide Act (Given Pursuant to Section 4 of the Insecticide Act): 1491-1525 On July 17, 1934, the United States attorney for the Northern District of Texas, acting upon a report by the Secretary of Agriculture, filed in the district court an information against William Jesse Lindsey, trading as the Star Chemical Co., Arlington, Tex., alleging shipment by said defendant on or about June 20, 1932, from the State of Texas into the State of Georgia of a quantity of Star Liquid Lime Sulphurous Compound which was a misbranded insecticide, other than Paris green and lead arsenate, within the meaning of the Insecticide Act of 1910. The article was alleged to be misbranded in that it consisted completely of inert substances or ingredients, that is to say, substances that do not prevent, destroy, repel, or mitigate insects when used as directed, and the name and the percentage amount of each of said inert substances present in the article were not stated plainly and correctly on the bottle label. The information also charged a violation of the Food and Drugs Act reported in notice of judgment no. 24122 published under that act. On December 5, 1984, the defendant entered a plea of guilty and the court imposed a fine of $25 as penalty for violation of both acts. Description : Excerpt from Notices of Judgment Under the Insecticide Act (Given Pursuant to Section 4 of the Insecticide Act), 1636-1655 On April 30, 1935, the United States attorney for the Western District of Washington, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 117 cans of Nourse Gall Remedy at Seattle, Wash.; alleging that the article had been shipped in interstate commerce on or about November 23, 1934, from Kansas City, Mo., by Nourse Oil Co.; and charging misbranding in violation of the Insecticide Act of 1910. The article was alleged to be misbranded in that the statement appearing on a leaflet shipped with it, Mange t Mange on Live Stock, Dogs and Household Pets are greatly benefited by its use, was false and misleading and tended to deceive and mislead the purchaser since the product was not an effective treatment for all varieties of mange which infest livestock, dogs, and household pets. The article also was alleged to be misbranded in violation of the Food and Drugs Act as reported in notice of judgment No. 29019 published under that act. On April 4, 1938, no answer to the libel having been filed, judgment of condemnation was entered and the product was ordered destroyed.
