Description : Excerpt from Mississippi Law Journal, 1928, Vol. 1 The fundamental purpose of the journal is to perform a distinct and valuable service, (a) to the bar of the state by creating a forum Where interesting and Vital legal ques tions of a helpful nature to the profession and the judiciary of the state may be discussed. A forum in which matters peculiarly of interest to the lawyers and law students may find expression. It is true the bar of the state and the law students have had the benefits of great law journals, such as the American Bar J ournal and others of like nature, but these publications do not and can not take care of the local needs. One feature of the journal which should appeal to the bar will be the publication of the annotations of our decisions and statutes to the re-statement of the common law by the American Law Institute. A committee was ap pointed by the Bar Association at the Gulfport meeting charged with the duty of working out some plan where by our decisions and statutes might be annotated to thelaw as restated by the American Law Institute. The com mittee has been able to procure Chief J ustice Sidney Smith and Honorable George Butler of the J ackson Bar, together with members of the law faculty, to annotate our decisions and statutes to the subjects of the law already restated and those subjects partially restated by the American Law In stitute, namely, Conflict of Laws, Torts, Contracts, and Criminal Law. This feature of the journal alone should be of great value to the bar in Mississippi, especially, since the Mississippi Supreme Court will cite the re-statement of the law, (b) it will open a forum for the student of law who is not in the active practice, both in and out of the law school, for the discussion of timely and pertinent legal questions, together with comments on and criticisms of cases and questions of law passed upon by the Mississippi courts. Description : Excerpt from The American Law Journal, 1852, Vol. 11: New Series, Vol. IV The plaintifl' had a right to run his coal boat, and the de fendants had a right to run their steamboat; but both must act out these rights with preper reference to their corelative duties. The rights of both are secured, and regulated by law; the right of navigation, by the general law of the river, and the right of moorage, by the local ordinances and customs of the harbor. It is a well known law of navigation, that vessels bavin full control of their motive power, shall give way to those whio are less manageable; and the rule commends itself to our common sense of justice. Hence a steamboat, in motion, must give way to coal boats. But it by no means follows that a steamboat, not in motion, is bound to give way. Any vessel may moor at the shore or near it, or in the middle of the river, and having a right to do ao - sub'ect to the duty of showing a light at night, if it be out in e thoroughfare - it is the ut of other vessels to keep clear of it. And there is no rule 0 law that, under ordinary circumstances, forbids one or more vessels moor ing outside of others at the shore. In Virginia, Kentucky, and every other State, where there is a Court of Chancery, the practice is different from ours. It is scarcely possible, that the Federal Court will follow our practice; in justice to citizens of other States they cannot do it, for though the Courts of this State, may be content with a practice Which submits Law, as well as fact, to the determination of a Jury, citizens of other States will not agree that their rights shall be launched into a sea of uncertainty, without compass or rudder.
