Description : Striking a proper balance between unilateral exercise of intellectual property rights on the one hand and competition rules on the other hand is not an easy exercise. The right owners’ unilateral behaviour of refusal to license is one such delicate issue, particularly for China, considering that it has not been clarif ied within existing competition rules how to assess a right owner’s specif ic unilateral practices. In a series of cases, the EU courts have established the exceptional circumstances in which the right owners’ refusal conduct might be considered as an infringement of EU competition rules. In general, Chinese competition law has been modelled after the EU competition rules. This book firstly examines the EU approaches on dominant undertakings’ refusal to license intellectual property rights and the follow-on pricing issue, and then explores to what extent the EU model could contribute to China’s anti-monopoly practice.

Description : Around the world, legal information managers, law librarians and other legal information specialists work in many settings: law schools, private law firms, courts, government, and public law libraries of various types. They are characterized by their expertise in working with legal information in its many forms, and by their work supporting legal professionals, scholars, or students training to become lawyers. In an ever-shrinking world and a time of unprecedented technological change, the work of legal information managers is challenging and exciting, calling on specialized knowledge and skills, regardless of where in the world they practice their profession. Their role within legal systems contributes substantially to the administration of justice and the rule of law. This International Handbook addresses the policy and strategic issues with which legal information managers and law librarians need to engage in the context of the diverse legal environments in which they work. It provides resources, analysis, and considered studies on an international basis for seasoned professionals, those about to enter the field, and anyone interested in the evolution of legal information in the twenty-first century.

Description : In this, the fourth edition of Private International Law and the Internet, Professor Dan Svantesson provides a detailed and insightful account of what has emerged as the most crucial current issue in private international law; that is, how the Internet affects and is affected by the five fundamental questions: When should a lawsuit be entertained by the courts? Which state’s law should be applied? When should a court that can entertain a lawsuit decline to do so? How wide ‘scope of jurisdiction’ should be afforded to a court with jurisdiction over a dispute? And will a judgment rendered in one country be recognized and enforced in another? Professor Svantesson identifies and investigates twelve characteristics of Internet communication that are relevant to these questions and then proceeds with a detailed discussion of what is required of modern private international law rules. Focus is placed on several issues that have far-reaching practical consequences in the Internet context, including the following: cross-border defamation; cross-border business contracts; cross-border consumer contracts; and cross-border intellectual property issues. A wide survey of private international law solutions encompasses insightful and timely analyses of relevant laws adopted in a variety of jurisdictions, including Australia, England, Hong Kong SAR, the United States, Germany, Sweden, and China, as well as in a range of international instruments. There is also a chapter on advances in geo-identification technologies and their special value for legal practice. The book concludes with two model international conventions, one on cross-border defamation and one on cross-border contracts, as well as a set of practical checklists to guide legal practitioners faced with cross-border matters within the discussed fields. Professor Svantesson’s book brings together a wealth of research findings in the overlapping disciplines of law and technology that will be of particular utility to practitioners and academics working in this complex and rapidly changing field. His thoughtful analysis of the interplay of the developing Internet and private international law will also be of great value, as will the tools he offers with which to anticipate the future. Private International Law and the Internet provides a remarkable stimulus to continue working towards globally acceptable private international law rules for communication via the Internet.

Description : Foreign direct investment in the natural resource industries is fostered through the signing of concession agreements between the host State and the investor. However, such concessions are susceptible to alteration by the host State, meaning that many investors now require the insertion of stabilization clauses. These are provisions that require the host State to agree that they will not take any administrative or legislative action that would adversely affect the rights of the investor. Arguing that it is necessary to have some form of flexibility in concession agreements while still offering protection of the legitimate expectations of the investor, Resource Nationalism in International Investment Law proposes the insertion of renegotiation clauses in order to foster flexible relationships between the investor and the host State. Such clauses bind the parties to renegotiate the terms of the contract, in good faith, when prevailing circumstances change. However these clauses can also prove problematic for both State and investor due to their rigidity. Using Zambia as a case study, it highlights the limitations of the efficient breach theory to emphasise the need for contractual flexibility.

Description : How will governments and courts protect civil liberties in this new era of hacktivism? Ethical Hacking discusses the attendant moral and legal issues. The first part of the 21st century will likely go down in history as the era when ethical hackers opened governments and the line of transparency moved by force. One need only read the motto “we open governments” on the Twitter page for Wikileaks to gain a sense of the sea change that has occurred. Ethical hacking is the non-violent use of a technology in pursuit of a cause—political or otherwise—which is often legally and morally ambiguous. Hacktivists believe in two general but spirited principles: respect for human rights and fundamental freedoms, including freedom of expression and personal privacy; and the responsibility of government to be open, transparent and fully accountable to the public. How courts and governments will deal with hacking attempts which operate in a grey zone of the law and where different ethical views collide remains to be seen. What is undisputed is that Ethical Hacking presents a fundamental discussion of key societal questions. A fundamental discussion of key societal questions. This book is published in English.

Description : The distinguished historian Winton U. Solberg presents a detailed case study of one institution's transformation into a modern American university. The years 1894 to 1904 mark the stormy tenure of Andrew S. Draper as president of the University of Illinois. Draper, a successful superintendent of schools with no college or university experience and no credentials as a post-secondary administrator, presided over many crucial improvements in the university's physical plant, curricula, and other areas. However, he failed to infuse the university with a spirit of cohesion, and his term as president was fraught with conflict. From his inauguration on, the autocratic Draper collided with deans and faculty who opposed both the substance of his changes and the manner in which he presented and implemented them. This volume closely examines the Draper years from the perspectives of faculty, students, and administrators. Solberg outlines the administrative, faculty, staff, and physical infrastructure. He also reveals a vibrant and varied student life, including a whirl of social activities, literary societies, intercollegiate debate and athletics, hazing, religion, and increasingly prominent fraternities. A sharply delineated and detailed picture of a university in transition, The University of Illinois, 1894-1904 traces the school's shift from an institution known primarily as a training ground for engineers to a full-fledged university poised to compete on the national level.
